Terms of Service

These Terms of Service ("Terms") govern your access to and use of timeoutpa.com (the "site") and any RSVPs, reservations, or inquiries you submit through it. The site is operated by Time Out On Pine ("we," "us," or "our"). By visiting the site, RSVPing for an event, or submitting any form, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the site.

Our nightlife events are restricted to guests who are 21 years of age or older. By RSVPing or attending, you represent that you are at least 21 and that you will present a valid government-issued photo ID at the door. We may refuse entry to anyone who cannot verify their age or identity. Private events booked through us may have different age requirements that we will confirm in writing in advance.

You agree to use the site only for lawful, personal, non-commercial purposes. You agree not to:

• Submit false, misleading, or impersonating information through any form or RSVP.
• Use the site to send spam, scrape data at scale, or interfere with how the site works for other guests.
• Attempt to gain unauthorized access to the site, its servers, or any related systems.
• Use the site or our brand to advertise, resell, or promote a third-party event without written permission.

We may suspend or block access if we reasonably believe you are violating these Terms.

RSVPs and reservation requests submitted on the site are requests, not guaranteed admission. Capacity, door cover, dress code, and entry policies are set by Time Out On Pine and may change. Please plan accordingly:

• Arrival. Arrive at the time noted in your confirmation. Late arrivals may lose held space if the venue is at capacity.
• Cancellations. If your plans change, please reply to your confirmation email or contact us so we can release the space to other guests.
• No-shows. Repeated no-shows on RSVPs may result in future RSVPs not being honored.
• Group RSVPs. The person who organizes a group RSVP is responsible for sharing event details, timing, and any cover with their guests.
• Private events & deposits. Private events, buyouts, and birthday packages may require a signed agreement and a deposit. Cancellation and refund terms for those bookings are set out in that separate agreement and control over these Terms for that booking.

Time Out On Pine is a hospitality venue and we expect all guests to behave accordingly. Management reserves the right, at its sole discretion, to refuse entry or remove anyone who is intoxicated to the point of risk, behaves in a harassing, threatening, discriminatory, or unsafe manner, or fails to follow staff instructions or posted house rules. Local, state, and federal laws apply on the premises at all times.

All content on the site — including the Time Out On Pine name and logo, page copy, photography, video, graphics, and event branding — is owned by or licensed to us and is protected by intellectual property laws. You may view and share links to the site for personal, non-commercial use. You may not copy, reproduce, modify, distribute, or use any of our content for commercial purposes without our prior written permission.

Photos and videos may be taken at the venue during events for promotional use. By attending, you acknowledge that you may appear in such material.

The site may link to third-party websites or services (for example, ticketing pages, social platforms, or maps) and we use third-party tools described in our Privacy Policy. We do not control those third parties and are not responsible for their content, terms, or practices. Your use of any third-party site or service is at your own risk and subject to that third party's terms.

The site, its content, and any RSVP or inquiry functionality are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. Event details, lineups, timing, and pricing may change without notice.

To the fullest extent permitted by law, Time Out On Pine, its owners, officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the site or attendance at any event. Our total liability to you for any claim arising out of or relating to these Terms or the site will not exceed one hundred U.S. dollars (USD $100). Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

You agree to indemnify and hold harmless Time Out On Pine and its owners, officers, employees, and affiliates from any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your misuse of the site, your violation of these Terms, or your violation of any rights of a third party.

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the site will be brought exclusively in the state or federal courts located in Philadelphia County, Pennsylvania, and you consent to the personal jurisdiction of those courts.

We may update these Terms from time to time. When we do, we will revise the "Last updated" date below. Material changes will be reflected on this page. Your continued use of the site after an update means you accept the revised Terms.
